The lawful basis for processing this personal information is that processing is necessary for our legitimate interests, namely communicating with prospective customers and others about our products and services. 
  • Comments and opinions. When you contact us directly, we will record your comments and opinions. We will use your comments and opinions to address your queries, issues and concerns, improve our products and services and to inform our direct marketing. The lawful basis for processing this personal information is that processing is necessary for our legitimate interests, namely communicating with prospective customers and others about our products and services. 

Personal information we collect automatically 

  • Information about your device: We also automatically collect personal information about the device you use to access the GRIDRACK Website, including your IP address, details about the type of device and browser you use. We use this information to display the GRIDRACK Website to you on your device and to optimize the GRIDRACK Website for the screen and browser window size. The lawful basis for processing this personal information is that processing is necessary for the performance of a contract with you. 
  • Information from social media networks. When you interact with us through a social media site or third-party service, such as when you like or share our content on Twitter or LinkedIn, we may receive information from the social network including your profile information, picture, user ID associated with your social media account, and any other information you permit the social network to share with third parties. The lawful basis for processing this personal information is that processing is necessary for our legitimate interests, namely interacting with prospective customers and others through social media. 
4. How long we keep your personal information 
  • We will store the personal information we collect for our own purposes for no longer than necessary for the purposes set out and in accordance with our legal obligations and legitimate business interests. 
  • In any event we will delete any personal information you provide to us when you contact us or sign up to our newsletter within eighteen (18) months of receiving it from you. 
  • We will also delete any personal information we collect about your device when you leave the GRIDRACK Website. 
5. Recipients 
  • As required in accordance with how we use your personal information, we may share your personal information with the following: (a) Companies in the same group as us: We may share personal information with other entities owned by or under common ownership with GRIDRACK. We do this to coordinate our group-wide strategy for promoting our products and services and communicating with prospective customers. (b) Service providers and advisors. We may share your personal information with third party vendors and other service providers that perform services for us or on our behalf, which may include providing mailing, email services, fraud prevention and web hosting. (a) Purchasers and third parties in connection with a business transaction. Your personal information may be disclosed to third parties in connection with a transaction, such as a merger, sale of assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business, insolvency, bankruptcy, or receivership (b) Law enforcement, regulators and other parties for legal reasons. We may share your personal information with third parties as required by law or if we reasonably believe that such action is necessary to (i) comply with the law and the reasonable requests of law enforcement; (ii) detect and investigate illegal activities and breaches of agreements; and/or (iii) exercise or protect the rights, property, or personal safety of GRIDRACK, its users or others. 
6. Subscriptions to our newsletter 
  • If you subscribe to our newsletter, we may email you from time to time with information about our products and services, such as product launches. 
  • You can change your preferences at a later date by clicking on the unsubscribe link at the bottom of our marketing messages. 
7. Storing and transferring your personal information 
  • We implement appropriate technical and organizational measures to protect your personal information against accidental or unlawful destruction, loss, change or damage. All personal information we collect will be stored on our secure servers. 
  • International Transfers of your personal information. The personal information we collect may be transferred to and stored in countries outside of the jurisdiction you are in where we and our third-party service providers have operations. If you are located in the United Kingdom ("UK") or European Economic Area ("EEA"), your personal information may be processed outside of the UK or EEA, including in the United States. We will ensure that these international transfers of your personal information are made pursuant to appropriate safeguards, such as: (i) ensuring that the personal information is only transferred to countries recognized as offering an equivalent level of protection as compared to the level of protection in the country you are located; or (ii) the transfer is made pursuant to appropriate safeguards, such as standard data protection clauses adopted by the European Commission.

8. Your rights in respect of your personal information Users from the UK or EEA 
  • If you are resident in the UK or EEA, in accordance with applicable privacy law you have the following rights in respect of your personal information that we hold: (a) Right of access. You can object to marketing activities for any reason.

(b) The Right to Request Deletion of personal information we have collected from you, subject to certain exceptions. (c) The Right to Opt Out of Personal Information Sales to third parties now or in the future. 
  • You also have the right to be free of discrimination for exercising these rights. However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you our products and services or engage with you in the same manner. 
9. How to Exercise Your California Privacy Rights 
  • You may submit a request to exercise your California Consumer Rights by emailing us using the contact details at the end of this privacy policy. 
  • Before processing your request, we will need to verify your identity and confirm you are a resident of the State of California. In order to verify your identity, we will generally either require the successful authentication of your membership, or the matching of sufficient information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you, including, but not limited to, your email, address, and phone number. 
  • In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request. 

Authorized Agents 

  • In certain circumstances, California residents are permitted to use an authorized agent to submit requests to know or delete personal information on their behalf through the designated methods set forth in this privacy policy, where we can verify the authorized agent’s authority to act on their behalf by: (a) receiving a power of attorney valid under the laws of California from the consumer or their authorized agent; or (b) receiving sufficient evidence to show that the consumer has: (i) provided the authorized agent signed permission to act on their behalf; (ii) verified the consumer’s own identity directly with us pursuant to the procedures set forth in this privacy policy; and (iii) directly confirmed with us that the consumer provided the authorized agent permission to submit the request on their behalf; and (c) for requests to opt-out of personal information "sales": receiving a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf. 

10. Links to third party sites

  • The GRIDRACK Website may, from time to time, contain links to and from third party websites, including those of other users, our partner networks, advertisers, partner merchants, news publications, retailers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites. 

11. Our policy towards children

  • The GRIDRACK Website is not directed at persons under 16 and we do not knowingly collect personal information from children under 16. If you become aware that your child has provided us with personal information, without your consent, either directly or by other means, then please contact us using the details below so that we can take steps to delete such information and terminate any account your child has created with us. 

12. Changes to this policy

  • We may update this privacy policy from time to time and so you should review this page periodically. When we change this privacy policy in a material way, we will update the "last modified" date at the end of this privacy policy. Changes to this privacy policy are effective when they are posted on this page.

  • If we need to provide you with information about something, whether for legal, marketing or other business-related purposes, we will select what we believe is the best way to get in contact with you. We will usually do this through email or by placing a notice on the GRIDRACK Website.
